1. About these terms

These terms apply to gptad.io, gptad.com.au, gptad.vn and gptad.com.vn, including their public brand-report tools. GPTAd is a product operated by Nudgen LLC. “GPTAd”, “we” and “us” refer to Nudgen LLC, whose business address is 8 The Green, Dover, DE 19901, United States. You can contact us at [email protected].

Please read these terms before using our services. If you request a report or engage our services, these terms apply to that use. A signed proposal, order or service agreement takes priority for the work it covers if it conflicts with these terms. Separate terms and privacy notices may apply to the GPTAd console and connected platforms.

2. Using GPTAd on behalf of a business

Our services are intended for people aged 18 or over acting for themselves or a business. If you act for an organisation, you must have authority to make the request and share its information. Provide accurate information and an email address you are authorised to use.

3. Our services and their limits

GPTAd provides search optimisation, AI visibility research and advertising support. Reports are snapshots based on the sources, prompts, regions and measurements available at the time. AI-generated material can be incomplete or incorrect. Review findings and verify important facts before relying on them.

We do not guarantee rankings, inclusion in AI answers, ad approval, placement, traffic, revenue or any particular business result. Platform availability and policies may change. GPTAd is independent and is not affiliated with or endorsed by OpenAI; ChatGPT is a trademark of OpenAI.

4. Responsible use

Use the services lawfully and respect other people’s rights. Do not submit confidential, sensitive or unlawfully obtained information, impersonate others, send spam, distribute malware, bypass access controls or rate limits, or interfere with the service.

Only submit websites and materials you are entitled to use for the requested analysis. Do not use the tools to access private systems or collect personal information without a lawful basis. You remain responsible for your advertising claims, targeting decisions and compliance with platform rules.

5. Your materials and our content

You keep your rights in the materials you provide. You give us permission to process those materials and share them with service providers only as needed to fulfil your request, operate the service and meet legal obligations, as explained in our Privacy Policy. This does not transfer ownership to GPTAd.

GPTAd retains rights in its website design, software and original content. You may use reports delivered to you for your own business, subject to any agreed service terms and third-party rights. Do not claim ownership of our software or resell the service without permission. Third-party sources and trademarks belong to their owners.

6. Reports and private links

A report link is accessible to anyone who has the link, without signing in. Keep it private and share it only with intended recipients. Online report links normally expire after seven days. Downloaded PDFs and emailed copies remain available to their recipients. We may limit report requests to protect capacity and prevent misuse.

7. Paid work, cancellation and refunds

A request for information or a public brand report does not by itself authorise a paid engagement. The scope, fees, currency, taxes, billing schedule, advertising budget and cancellation arrangements for paid work will be set out in the proposal, order or service agreement you accept.

Third-party advertising spend and platform fees are separate unless expressly included. Refunds and cancellation rights follow the applicable agreement and mandatory law. Nothing in these terms removes a refund or other remedy you are legally entitled to receive.

8. Third-party services

Our websites may link to or use scheduling, analytics, research, email and advertising providers. Their own terms and privacy policies govern your direct use of their services. We do not control their availability, content or decisions. Our use of providers to handle personal information is described in our Privacy Policy.

9. Availability and suspension

We may maintain, update or discontinue public tools, or restrict access where reasonably necessary to address misuse, security risks or legal requirements. We aim to give reasonable notice where practical. Any paid-service obligations remain subject to your agreement and applicable law.

10. Your legal rights and responsibility for loss

Nothing in these terms excludes or restricts rights or remedies that cannot lawfully be excluded, including consumer guarantees under the Australian Consumer Law and applicable Vietnamese consumer protection law.

Subject to those rights, public information and free tools are provided as available, without a promise that they will be error-free or uninterrupted. Responsibility for any loss is determined under applicable law and, for paid work, the agreed service terms. You should independently assess recommendations before making business decisions.

11. Questions and disputes

Contact [email protected] with any concern so we can try to resolve it with you. These terms do not require mandatory arbitration or prevent you from contacting a regulator, seeking legal remedies or bringing a claim in a court available to you under applicable law. Any governing-law provision for paid work will be stated in the relevant agreement and will not override mandatory protections.

12. Changes and language

We may update these terms as the services or legal requirements change. The date at the top identifies the current version. Material changes will be brought to your attention where required; changes do not retrospectively alter an accepted paid agreement without a lawful basis or your agreement.

The English and Vietnamese versions are intended to have the same meaning. Neither version is intended to reduce your mandatory legal rights. Please contact us if you notice a difference or need clarification.
